Chapter 01
Acceptance of Terms
The agreement that applies when you access or use SendHoney.
By accessing or using SendHoney ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
Chapter 02
Description of Service
The platform capabilities covered by these terms, including CRM, ERP, channels, automation, and AI features.
SendHoney provides a self-hosted business operations platform including CRM, ERP, multi-channel messaging, contact center, workflow automation, and AI-powered features. The Platform may be deployed on your own infrastructure or on infrastructure managed by SendHoney.
Chapter 03
Accounts and Registration
The account information, accuracy, and credential responsibilities required to use protected features.
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities under your account.
Chapter 04
Subscription and Billing
How paid subscriptions, billing cycles, fee changes, and refund limits are handled.
Certain features require a paid subscription. Fees are billed in advance on a monthly or annual basis as selected. All fees are non-refundable except as required by law or expressly stated in these Terms. SendHoney may change fees upon 30 days' notice. Continued use after a fee change constitutes acceptance of the new fees.
Chapter 05
Acceptable Use
The platform use restrictions that protect SendHoney, customers, users, and connected services.
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws
- Transmit spam, unsolicited messages, or malicious code
- Attempt to gain unauthorized access to the Platform or related systems
- Interfere with or disrupt the integrity or performance of the Platform
- Reverse engineer, decompile, or disassemble the Platform software
- Resell or redistribute the Platform without explicit written permission
Chapter 06
Data and Privacy
Customer data ownership and the security posture for managed and self-hosted deployments.
You retain all rights to your data. SendHoney processes your data in accordance with our Privacy Policy. For self-hosted deployments, your data remains entirely under your control. For managed deployments, we implement industry-standard security measures to protect your data.
Chapter 07
Intellectual Property
The license rights granted for platform use and the ownership protections for SendHoney software and brand assets.
The Platform, including its software, design, logos, and content, is protected by intellectual property laws. SendHoney grants you a limited, non-exclusive, non-transferable license to use the Platform for your internal business purposes during the term of your subscription.
Chapter 08
Service Level and Availability
The availability expectations for managed services and the responsibilities that stay with self-hosted deployments.
SendHoney will use commercially reasonable efforts to make the Platform available. For managed deployments, uptime commitments are specified in the applicable service level agreement (SLA). Self-hosted deployments are your responsibility, and SendHoney does not guarantee availability.
Chapter 09
Limitation of Liability
The liability limits that apply to indirect damages, lost profits, lost data, and similar claims.
To the maximum extent permitted by law, SendHoney shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Chapter 10
Indemnification
The claims and expenses customers are responsible for when platform use violates these terms.
You agree to indemnify and hold harmless SendHoney and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Platform or violation of these Terms.
Chapter 11
Termination
When access may be suspended or terminated and what happens to platform use rights afterward.
SendHoney may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will cease immediately.
Chapter 12
Changes to Terms
How SendHoney may update these terms and notify customers of material changes.
SendHoney reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Your continued use after changes constitutes acceptance of the modified Terms.
Chapter 13
Governing Law
The jurisdiction and courts that govern disputes under these terms.
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Nairobi, Kenya.
